The Role of Nominations in Union Territories (UT) Assemblies

• Rajya Sabha has 12 members, nominated by the President on the advice of the Union Council of Ministers.

• Legislative Assemblies of three Union Territories are governed by Parliament acts.

• The Union Home Ministry proposes that the Lieutenant Governor of Jammu & Kashmir can nominate five members to the Legislative Assembly without its Council of Ministers’ advice.

• The Indian Constitution allows nominated members in Parliament and State legislature houses.

• The Government of Union Territories Act, 1963 allows up to three members to be nominated to the Puducherry Assembly.

• The J&K Reorganisation Act, 2019 provides for 90 elected seats in the Legislative Assembly of J&K.

• The Supreme Court has ruled on the procedure for nomination of members to the Puducherry Assembly.

• The ‘triple chain of command’ concept suggests accountability to civil servants, ministers, legislature, and electorate.
